Wills

Anyone who is 18 years of age or older and of sound mind has the right under U.S. law to prepare a will. By doing so, he or she becomes a "testator". A will is the legal document that outlines the distribution of property after the testator dies. Such property (collectively referred to as the estate) might include personal effects, real estate, and the funds in any financial accounts. One or more persons can be named as inheritors. These inheritors are usually family members, but charitable organizations are frequently included also. A testator can change his/her will at any time prior to death. A will can be used to designate a preferred guardian for any minor children. A trustee or executor may also be named. A trustee often handles property on behalf of an inheritor (such as a minor child) who cannot make his/her own financial decisions. An executor is responsible for administering various aspects of the testator's estate such as filing the appropriate forms in probate court. A will may be contested in court if the testator's survivors believe it is not valid. If a person dies without making a will, the courts distribute all property according to the laws of the state.
